1. Service Description
AgentPortraits AI (“Service”) provides AI-generated professional headshots and virtual staging for real estate agents. We train a personalized model on photos you upload and generate images you can download for your business use.
2. User Accounts
You must provide accurate registration information and keep your credentials secure. You're responsible for activity on your account. You must be at least 18 years old.
We may suspend or terminate accounts for violations of these terms, for fraud, or where required by law.
3. Payments & Refunds
Bundle and subscription pricing is shown at checkout. Payment is processed by LemonSqueezy. Subscriptions auto-renew until cancelled. You can cancel any time from the Billing page.
Refunds: Bundles are eligible for a full refund within 7 days of purchase if you have not yet trained an AI model. Once training has started, the bundle is non-refundable because compute costs are incurred immediately. Subscriptions can be cancelled at any time; the current billing period is non-refundable.
If staging or generation fails because of our system, the corresponding credit is automatically refunded to your account.
4. Intellectual Property
Your photos. You retain ownership of all photos you upload. By uploading, you grant AgentPortraits AI a limited license to process them for the sole purpose of training your model and delivering the Service.
Generated images. You own the AI-generated headshots and staged room images we produce for you. You may use them for personal, marketing, and commercial real-estate purposes.
Service IP. The Service, including its software, design, and trained pipelines, remains the property of AgentPortraits AI. You may not reverse engineer, scrape, or resell the Service.
5. AI-Generated Content Disclaimer
AI models can produce unexpected results, including artifacts, biases, or inaccurate likeness. We do not guarantee that every generated image will be usable. You agree to review generated images before publishing them and to comply with applicable laws and platform rules.
6. Virtual Staging Disclosure
All staged room images returned by the Service include a “Virtually Staged” watermark on the watermarked output. You agree to use the watermarked version for any MLS or public listing, in compliance with NAR guidelines and applicable state law (including California AB 723). Misrepresenting a virtually staged photo as an actual photograph is your sole responsibility and may violate law.
7. Acceptable Use
You agree not to use the Service to:
- Upload images of any person without their consent;
- Generate content depicting minors in inappropriate contexts;
- Generate sexually explicit, defamatory, hateful, or harassing content;
- Impersonate another person or generate political deepfakes;
- Violate intellectual property or privacy rights of others;
- Probe, scan, or test the vulnerability of the Service.
8. Limitation of Liability
To the maximum extent permitted by law, the Service is provided “as is” without warranties. AgentPortraits AI is not liable for indirect, incidental, special, or consequential damages, including lost listings, lost profits, or reputational harm. Our aggregate liability under these terms will not exceed the amount you paid us in the 12 months prior to the claim.
9. Termination
You may delete your account at any time from Settings. We may suspend or terminate your access for violations of these terms or for non-payment. Upon termination, your data will be deleted in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these terms occasionally. Material changes will be announced via email or in-app notice. Continued use after a change constitutes acceptance.
